This Privacy Policy explains how NomNomWeb.com and its subsidiaries and affiliates (“NomNomWeb.com”, “we”, “us” or “our”) collect, use, disclose, and otherwise process personal information in connection with our Platform and Services. Our Platform includes: (i) our websites, including related subdomains, (ii) our mobile, tablet, and other smart device applications, (iii) application program interfaces, (iv) in-store kiosks and other online services, and (v) any other tools, technology, and programs now or in the future; in each case, that reference this Privacy Policy. “Services” includes all services associated with the Platform.

Throughout this policy, we will clarify those portions that apply to Users who are using the Platform on behalf of a restaurant (“Merchant”) and those portions that apply to Users who are placing an order from a restaurant that is processed through the Service (“Customer”).

This Privacy Policy does not cover or address: the privacy practices of Merchants available on our Platform, including their authorized licensees and franchisees; branded channel services provided to Merchants, and third vendors not affiliated with NomNomWeb.com.

If you see any undefined term in this Privacy Policy, it has the definition specified in our Terms of Use.

By accessing or using the Platform and/or Services, you agree that you have read, understood, and agree to our collection, storage, use, and disclosure of your personal information as described in this Privacy Policy and our Terms of Use.


Personal Information

Personal Information is generally any information that can be used to identify you individually, either by itself or in conjunction with other information. Personal Information may be also referred to as “Personally Identifiable Information”.

Personal Information that NomNomWeb.com may collect includes but aren’t limited:

  • Contact Information, such as your full name (or alias), phone numbers, email addresses, and postal addresses.

  • NomNomWeb Account credentials such as a username, password, or similar security information used for authentication purposes.

  • Online identifiers, such as your Internet Protocol Address, also known as “IP address”, basic browser information, or other device information, whether or not that information is linked to other personal information or non-personal information that allows that individual to be identified.

  • Demographic or Location Data, whether or not that information is linked to other personal information or non-personal information that allows that individual to be identified.

We use Personal Information to not only process orders and provide insight to Merchants about their online customers’ behavior but to also investigate misuse and abuse on the platform and to also identify and terminate illegal or suspicious activity.

NomNomWeb does not collect or store payment data. All payment is collected via Stripe through an embedded form hosted by Stripe.

How We Collect Personal Information: We collect personal information described above the moment you use any of our services such as online identifiers and location data. If Customer creates an account, logs in to an existing account, or places an order (while logged in or as a guest), we collect Contact Information so Merchant can process and complete the Customer’s order. You should review the Merchant’s privacy policy and contact each Merchant directly for questions regarding their storage and use of your Personal Information.

NomNomWeb.com also collects personal information from online forms on our Platform.

Non-Personal Information: Non-Personal Information includes information that is about you or about your use of our Platform but does not identify you personally including but not limited to:

  • Anonymous usage data

  • Referring pages, exit pages, outbound links, inbound links, and URL’s

  • Browser or platform type

  • Internet connection, connection speed, ISP (if available)

  • Details about equipment used to access the service

  • Mobile device ID (IMEI), model, and/or manufacturer

  • Language preferences and referring sites

  • Date and Time of User Requests

All information we collect from you depends entirely on how you use and interact with us on our Platform. If you do not agree with our data collection policy, we do not recommend using our Platform.

How We Collect Non-Personal Information: We generally collect non-personal information using data collection technologies and analytics tools - both in-house and third party such as Google Analytics and Splunk to collect anonymous information from your device and browser about your browsing patterns, access, use, and interactions with the Platform. The information we collect automatically is statistical data and generally does not contain any Personal Information. We use this information to maintain the security and operation of our Platform and to gain actionable insight that help our team improve the Platform.

The Technologies We Use For Automatic Data Collection described above may include the following:

  1. Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. We may refuse to accept browser cookies by activating the appropriate settings on your browser. However, refusing to accept cookies may hinder your ability to use or interact with our Platform. Unless you have adjusted your browser settings to that it will refuse cookies, our system will continue to issue cookies when you direct your browser to our Platform. These cookies are not the edible kind.

  2. Web Beacons. Components of the Platform and our marketing emails may contain small electronic files known as Web Beacons (may also be referred to as clear gifs, pixel tags, and single pixel gifs) that permit NomNomWeb.com, for example, to count visits, check email open rates, and collect website statistics (for example, verifying system and server integrity and detecting fraudulent page visits).

  3. IP Addresses. We collect IP addresses for security and fraud prevention. Because IP addresses allow us to estimate the general location of a User on our Platform, it helps us identify, block, and blacklist sources of fraudulent activity in order to protect our Merchants. We also use IP addresses to help our Customers by preventing them from ordering from a restaurant that is not within a reasonable serviceable area (Customer is located in California but trying to order from a similarly named Merchant in New York).

  4. Hotjar. We use Hotjar to record user behavior anonymously. Hotjar cannot see any personally identifiable information such as names, dates, phone numbers, addresses, payment information, passwords, etc etc. For more information about Hotjar and their privacy policy, click here.

  5. FingerprintJS. We use FingerprintJS to anonymously collect device information in order to track and block unwanted traffic.

Do Not Track Disclosure: You may set your browser to transmit a “Do Not Track” signal to websites and online services you visit. At this time, we do not respond to or alter our practices when our Platform receive a “Do Not Track” signal from a user’s web browser. If you do not agree with this policy regarding Do Not Track, we do not recommend using our Platform.
